Attorney Files Medical Board Complaint After Jane Doe's Arrest Following Botched Abortion
Updated: May 15, 2021
Abortion On Trial recently released video footage of an incident that happened on September 1st, 2020, at the Women's Reproductive Clinic abortion facility in New Mexico. That footage shows Jane Doe*, a patient of the clinic, and her husband being placed under arrest after returning to the facility due to a botched surgical abortion. In the video, Jane can be heard saying she was "in so much pain" and that she "got no answers" from the abortion clinic as she is led away by police.
Pro-life advocates on the scene called AOT's attorney, Mike Seibel, who has been retained as legal representation for Jane. He says, "Dr. Theard's abandonment of Jane is not only a violation of the licensing act, but is also unprofessional, unethical, and is borderline criminal conduct." Mr. Seibel has now filed a letter of complaint with the New Mexico Medical Board on behalf of Jane and is currently awaiting a response.
That complaint letter (included below) states that in addition to the abandonment of Jane's medical needs, Dr. Theard's office has also refused or otherwise failed to produce medical records for Jane despite legal requests and requirements to do so. Jane has unsuccessfully been attempting to get access to her own medical records since September 1st.
"The apparent lack of concern shown by Dr. Theard and his staff in this instance is appalling," says Abortion On Trial's Executive Director, Jamie Jeffries. "Jane wasn't properly cared for or treated with dignity by this provider. She was mistreated, abandoned, and ultimately arrested on the day she delivered her baby into her own hands. The insurmountable trauma this abortion facility may have just caused this young woman is the exact opposite of empowering her."
Dr. Theard has a documented history of failed clinic inspections and medical malpractice lawsuits, all of which Jane's attorney was sure to include attached to her complaint.
The public is hopeful the Medical Board in New Mexico will take appropriate action and fully investigate the complaints made against Dr. Theard and his abortion facility.
